TERMS AND CONDITIONS OF USE OF THE WEBSITE

 

  1. Acceptance of the Terms of Use

 

The present Conditions of Use regulate the use of the Website that the Co4Tran Project makes available to the Users.

 

The Conditions of Use together with the Legal Notice, the Personal Data Protection Policy and the Cookies Policy constitute together the terms and conditions that govern the access and use of the public part of the Website (the “Website Terms and Conditions”).

 

By accessing and using the Website, the User accepts in full and agrees to be bound by the Website Terms and Conditions in their entirety. Therefore, the User must read carefully the present Conditions of Use as well as the remaining Terms and Conditions of the Website each time he/she intends to use the Website, since these may undergo modifications that would be communicated to the User with the new access. CONACEE reserves the right to update, modify or eliminate the present Terms and Conditions of the Website.

 

  1. Conditions of use of the Website

 

The User undertakes to make good use of the Website, being understood as good use that which is in accordance with the legislation in force, good faith and public order. Likewise, the User undertakes not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of CONACEE or third parties. Likewise, the User undertakes not to carry out any act with the purpose of damaging, rendering useless or overloading the Website, or preventing, in any way, its normal use and operation.

 

The User is informed that, in the event that he/she fails to comply with the content or obligations derived from the Terms and Conditions of the Website or any other particular terms or conditions included in the Website, CONACEE reserves the right to limit, suspend or terminate his/her access to the Website, adopting any technical measure that may be necessary for such purpose. Likewise, CONACEE reserves the possibility of exercising such measures in the event that it reasonably suspects that the User is violating any of the terms included in the Terms and Conditions of the Web Site or any other particular terms or conditions included in the Web Site.

 

CONACEE reserves the right to update, modify or eliminate the information contained in the Web Site, including the contents and/or services included therein, and may even limit or not allow access to such information, at any time and without prior notice. Specially, CONACEE reserves the right to eliminate, limit or prevent access to the Web Site when technical difficulties arise due to facts or circumstances beyond CONACEE’s control that, in its judgment, diminish or annul the security levels or standards adopted for the adequate operation of said Web Site. CONACEE and the Co4Tran Project Partners are the owner or legitimate licensee of the intellectual and industrial property rights over the Web Site and the elements that integrate it at any time, including graphics, texts, photographs, videos, sound files, trademarks and other distinctive signs, computer programs and sui generis rights over the underlying databases, the graphic design and user interface (look & feel) and the underlying computer programs (including the source and object codes) (the “Contents”).

 

The use of the Website by the User does not grant the User any rights over the intellectual and industrial property rights over the Website and the Contents. To this effect, by means of these Conditions of Use, except in those cases in which it is legally permitted or with prior authorization from on its capacity of Coordinator and Leader of the Co4Tran project , the reproduction, transformation, distribution, public communication, making available, extraction and/or reuse of the Web Site and its Contents is expressly forbidden to the User. CONACEE reserves the right to exercise the corresponding legal actions against the Users who violate or infringe the intellectual and/or industrial property rights.

 

CONACEE grants, to the Users who respect the Terms and Conditions of the Website an authorization to use the Website, with non-exclusive character, during the maximum period of validity of the intellectual and industrial property rights as established by the applicable regulations (except in case of suspension of access to the Website for justified cause) and with the purpose that the User may use the Website in accordance with the present document.

 

CONACEE and the Co4Tran Project Partners are not responsible for the information contained in the Website meeting the User’s expectations. CONACEE and the Co4Tran Project Partners are not responsible for the truthfulness, accuracy, sufficiency, integrity or updating of the information that is not of its own elaboration and of which another source is indicated. Neither is CONACEE nor the Co4Tran Project Partners are responsible for the opinions or comments that may appear in the Web Site, since they could either be made by the Users in their personal capacity, or come from the sources indicated.

 

CONACEE reserves the right to update, modify or eliminate the information contained in the Web Site in the terms indicated above, not assuming any commitment to communicate changes or modify the content of the same.

 

The User ACKNOWLEDGES AND ACCEPTS CONACEE’s previous declarations and additionally GUARANTEES compliance with the regulations applicable to him/her as a User of this Website.

4.1.Establishment of links to the Website

 

The establishment of links to the Website is prohibited, unless it has been previously authorized by CONACEE. In any case, once the link has been authorized by CONACEE, it must be established in the following terms:

In the event of non-compliance with any of the aforementioned terms, CONACEE may adopt the appropriate legal measures to that effect.

 

4.2 Linked Sites

 

In order to help the User to find additional information, CONACEE could include diverse technical devices of links that allow the User to access other webs (the “Linked Sites”). In these cases, CONACEE acts as a provider of intermediation services, according to the provisions of article 17 of the LSSI. In accordance with the provisions of the aforementioned legislation, CONACEE shall not be responsible for the services and contents provided through the Linked Sites, unless it has effective knowledge of the unlawfulness and has not deactivated the link with due diligence.

 

In no case does the existence of Linked Sites imply recommendation, promotion, identification or conformity of CONACEE with the manifestations, contents or services provided through the Linked Sites. Consequently, CONACEE is not responsible for the content of the Linked Sites, nor for their conditions of use and privacy policies, being the User the only responsible for checking and accepting them each time he/she accesses and uses them.

 

  1. Communication of activities of an illicit and inappropriate nature

 

In the event that the User or any other Internet User becomes aware that any kind of information or content of the Website or provided through the same is illicit, harmful to the rights of third parties, harmful, denigrating, violent, inadequate, contrary to what is established in these Conditions of Use or, in any other way, contrary to morality, uses and good customs, he/she may contact CONACEE indicating the following points:

 

  • personal data of the caller: name, address, telephone number and e-mail address;
  • description of the facts that reveal the illicit or inadequate nature of the content or information, as well as the specific address where it is available;
  • in the event of infringement of third party rights, such as intellectual and industrial property, the data of the holder of the infringed right must be provided when it is a person other than the communicating party. Likewise, the title accrediting the ownership of the infringed rights must be provided and, if applicable, the representation to act on behalf of the owner when it is a person different from the communicating party.

 

The reception by CONACEE of the communication foreseen in this clause will not suppose, according to the provisions of the LSSI, the effective knowledge of the activities and/or contents indicated by the communicant when this is not not notorious or evident. In any case, CONACEE reserves the right to suspend or withdraw the contents that, even though not illicit, are contrary to the norms established in these Conditions of Use, weighing in each case the legal assets in conflict.

 

  1. CONACEE’s Responsibility

 

The User must know that communications through open networks are exposed to a plurality of threats that make them unsafe. It is the User’s responsibility to adopt all the adequate technical measures to reasonably control these threats and, among them, to have updated systems of detection of malicious software, such as virus, Trojans, etc., as well as to have updated the security patches of the corresponding browsers. For more information, please contact your Internet access service provider, who will be able to provide you with the appropriate solutions for your needs. To the maximum extent permitted by the applicable legislation, CONACEE is not responsible for the damages caused to the User as a consequence of risks inherent to the means used, nor for those caused by vulnerabilities in its systems and tools. CONACEE does not guarantee either the total security of its systems and although it has adopted adequate security measures, the existence of vulnerabilities cannot be totally ruled out and, consequently, the User must be cautious when interacting with the Website.

 

In particular, CONACEE will not be responsible for:

 

Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojans or any other harmful element.

Damages of any kind caused to the User as a result of failures or disconnections in the telecommunication networks that produce the suspension, cancellation or interruption of the Website’s service during the provision of the same. In this respect, the User recognizes that access to the Website requires services supplied by third parties outside the control of CONACEE (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation do not correspond to CONACEE, nor is it part of its responsibility to guarantee the availability of the service.

 

Of the information of third parties in the cases in which CONACEE acts as a provider of intermediation services in the sense given by the LSSI, except when there is effective knowledge and the corresponding information has not been withdrawn.

 

CONACEE shall not be responsible either for the damages, direct or indirect, that the Users may suffer due to an inadequate use of this Web Site or its content, and does not assume any commitment to communicate changes or modify the content of the same.
